Temporary humanitarian

Victim of human trafficking or witness reporting to the police
You can apply for a residence permit if you are a victim of human trafficking. Or if you witnessed human trafficking and reported it to the police.
Police report by a witness or victim
Did you report human trafficking to the police? The police will let the IND know. Then the IND will decide whether you get a residence permit.
No police report filed by the victim
Are you a victim of human trafficking and have you not reported it? But you cooperated in another way in the criminal investigation and prosecution of the human trafficker? The police will report this to the IND. The IND will then decide whether you will receive a residence permit.
Are you a victim of human trafficking and did you not report it to the police? And are you not able to cooperate otherwise in the criminal investigation and prosecution of the human trafficker? Because you are underage, ill, or because you are being threatened? Then you can apply for a residence permit yourself.

Child under supervision
A child can apply for a residence permit if a court has put them under the supervision of a family guardian. If your child is put under supervision, you are required to accept help in bringing up your child. Does the child get a residence permit? Then the parents, brothers, and sisters can also apply for a residence permit.
Did the child already have a residence permit before they were put under supervision? Then the child can usually keep it.

Temporary placement in a foster home or institution based on The Hague Child Protection Convention
A child can apply for a residence permit if they are temporarily placed in a foster home or institution, based on The Hague Child Protection Convention. The central authorities of the Netherlands and the country of origin must have given permission for this placement beforehand. The authorities of the country of origin must also have arranged custody of the child. The Dutch Central Authority (CA) will give this information to the IND.

Unable to leave the Netherlands through no fault of your own
You can apply for a residence permit if you, through no fault of your own, cannot leave the Netherlands. These are some of the requirements for this residence permit:
- There is no doubt about your identity and nationality.
- You have tried to leave the Netherlands yourself.
- You have asked for help from the Repatriation and Departure Service (in Dutch: Dienst Terugkeer en Vertrek or DTenV).
- DTenV gave an advice which states that you cannot leave the Netherlands and this is not your fault.

Westernised Afghan girls and their family
Afghan minor girls who attend school can apply for a residence permit. These are girls who have become so westernised that they cannot return to Afghanistan anymore. After the application has been granted, family members of these girls can also apply for a residence permit.

Terminal illness
You can apply for a residence permit if you are in the Netherlands and you are terminally ill. Terminally ill means you can no longer get better and will pass away. You are no longer receiving medical treatment, except for palliative care. This is care for people who will not recover.

Article 8 ECHR (private life)
You can apply for a residence permit for the protection of your private life based on Article 8 ECHR. ECHR is the abbreviation for the Convention for the Protection of Human Rights and Fundamental Freedoms.

Placement until age 18 in a foster home or institution based on The Hague Child Protection Convention
A child can apply for a residence permit if they have been placed in a foster home or institution based on The Hague Child Protection Convention. The child must stay at the foster home or institution until they turn 18. The central authorities of the Netherlands and the country of origin must have given permission for this placement beforehand. The authorities of the country of origin must also have arranged custody of the child. The Dutch Central Authority (CA) will give this information to the IND.

Child and termination of parental authority
A guardian can apply for a residence permit for a child, if the parental authority over the child has ended. A court does this and also appoints a guardian immediately.
What if the child already has a residence permit to stay with their parents? Then the child cannot keep this residence permit. The guardian must apply for a non-temporary humanitarian residence permit for the child.
Family of soldiers at Joint Force Command Headquarters
You can apply for residency as a family member of a soldier at the NATO Joint Force Command Headquarters in Brunssum. The soldier must have a privileged status. Host Country Netherlands (in Dutch: Nederland Gastland) of the Ministry of Foreign Affairs is responsible for the stay of privileged people. Find out more about Foreign Affairs on government.nl.
Pilot Accommodation Scheme for non-EU students from Aachen
The pilot accommodation scheme for non-EU students from Aachen was a collaboration between Germany and the Netherlands. The pilot scheme lasted 5 years and stopped on 1 April 2021. Because of this, you cannot apply for a new residence permit. You can still extend a current residence permit. Do you want to find out more about the requirements and process? Residence permit for Surinamese former Dutch citizens
Are you Surinamese and did you have the Dutch nationality before 1975? And did you lose the Dutch nationality when Suriname became independent on 25 November 1975? Or as a result of the Dutch-Surinamese ‘Agreement concerning the assignment of nationality’ (in Dutch: Toescheidingsverklaring)? Then you may get a residence permit because of a one-time humanitarian regulation. You must meet all the requirements of the regulation. You can only submit the application between 1 January 2025 and 1 July 2025.
